La adecuada protección de los conocimientos tradicionales desarrollados por comunidades indígenas y locales enfrenta retos por la complejidad de definir tanto el objeto de protección como el sujeto beneficiario. En este caso, una definición general favorece una acción mancomunada de las partes interesadas. Sin embargo, no deben dejarse de lado especificidades que revisten ciertos saberes y detentores de estos, que también ameritan ser tutelados. Desde el ámbito de las patentes de propiedad intelectual, es plausible que sirvan de protección en favor de los detentores de conocimientos tradicionales. Interaction between traditional knowledge and patents
La adecuada protección de los conocimientos tradicionales desarrollados por comunidades indígenas y locales enfrenta retos por la complejidad de definir tanto el objeto de protección como el sujeto beneficiario. En este caso, una definición general favorece una acción mancomunada de las partes interesadas. Sin embargo, no deben dejarse de lado especificidades que revisten ciertos saberes y detentores de estos, que también ameritan ser tutelados. Desde el ámbito de las patentes de propiedad intelectual, es plausible que sirvan de protección en favor de los detentores de conocimientos tradicionales. Para optimizar esta modalidad de amparo sería conveniente auscultar la posibilidad de flexibilizar los estándares para el otorgamiento de patentes. Así mismo, para impedir la apropiación indebida por medio de patentes sería interesante llegar a un mayor consenso en torno al concepto de divulgación pública tanto como factor que diluye la novedad de la invención, como obligación que recae en cabeza del solicitante de patente.
Adequate protection of traditional knowledge developed by traditional and local communities faces challenges due to the complexity of defining both the object of protection and the beneficiary subject. In this case, a general definition favors joint action by stakeholders. Nevertheless, attention should also be paid to specific knowledges and their respective holders which also merit protection. From the domain of intellectual property patents, it is plausible that they serve as safeguard for traditional knowledge holders. To optimize this modality of protection it would be convenient to explore the possibility of flexibilizing standards for granting patents. Moreover, to prevent undue appropriation through patents, it would be interesting to reach more consensus regarding the concept of public disclosure, both as factor that dilutes novelty of an invention and as an obligation to be observed by the patent applicant.
