Sumario:
Actualmente el porteador necesita recurrir una variedad de auxiliares para el cumplimiento de las obligaciones contractuales que asume. Por tanto, su actuación influye de forma determinante en la ejecución de los contratos de transporte y en la responsabilidad que surge cuando se produce algún incumplimiento, en particular por daños en las mercancías. A pesar de ello, durante muchos años el auxiliar del porteador ha sido excluido del derecho uniforme sobre transporte internacional de mercancías por mar. Sin embargo, como se expone en este artículo, el legislador internacional se ha visto obligado a reconocer paulatinamente esta realidad e incluirla de alguna forma en los distintos textos internacionales.

Por tanto, su actuación influye de forma determinante en la ejecución de los contratos de transporte y en la responsabilidad que surge cuando se produce algún incumplimiento, en particular por daños en las mercancías. A pesar de ello, durante muchos años el auxiliar del porteador ha sido excluido del derecho uniforme sobre transporte internacional de mercancías por mar. Sin embargo, como se expone en este artículo, el legislador internacional se ha visto obligado a reconocer paulatinamente esta realidad e incluirla de alguna forma en los distintos textos internacionales. Nowadays the carrier needs to use different kind of assistants to fulfill contractual obligations assumed. Therefore, its behavior influences decisively in the implementation of transport contracts and the responsibility that arises when a default happen, especially damage to the goods. Despite this, for many years the carrier’s assistant has been excluded from the uniform law for international carriage of goods by sea. However, as discussed in this article, the international legislator has gradually been forced to recognize this fact and to included it in the international agreements.
