Durante la última década, la discusión sobre el valor de la empatía en el derecho y la filosofía ha cobrado una visibilidad creciente. Desde sus inicios a comienzos de la década de 1970, el movimiento “Derecho y Literatura” ha estado asociado a la introducción de la empatía en el derecho y, a la vez, la empatía ha sido uno de los focos de discusión más intensos dentro de las múltiples voces que integraron el movimiento. Reconsidering empathy in the “Law and Literature” movement
Durante la última década, la discusión sobre el valor de la empatía en el derecho y la filosofía ha cobrado una visibilidad creciente. Desde sus inicios a comienzos de la década de 1970, el movimiento “Derecho y Literatura” ha estado asociado a la introducción de la empatía en el derecho y, a la vez, la empatía ha sido uno de los focos de discusión más intensos dentro de las múltiples voces que integraron el movimiento. En ese marco, este trabajo se ocupa de reconsiderar la caracterización y el rol de la empatía en el seno del movimiento “Derecho y Literatura” como un sitio de privilegio para revisar la fuerza, las pretensiones y los efectos del argumento que pretende reivindicar a la empatía en el derecho y la vida pública; así como también para revisar las críticas de distinto tenor que enfrenta.
In the last decade, empathy has gained a prominent place in law and philosophy. Since its beginnings in the 1970s, the “Law and Literature” movement was associated with the consideration of the value of empathy in the world of the law but also, empathy was a highly contested terrain within the different voices of the movement. In this context, the paper reconsiders the role and characterization of empathy in the “Law and Literature” movement as a privilege site to calibrate the strenght, pretentions and the effects of the “empathy argument”; and also to reexamine its critical points.
