Sumario:
La regulación civil de la capacidad de ejercicio se ha visto transformada por las convenciones sobre los derechos del niño y sobre los derechos de las personas con discapacidad. En este trabajo se indagan las proyecciones de dichos cambios en tres aspectos: la tensión entre autonomía y protección, las transformaciones en relación con los representantes y apoyos, y el desborde de la noción civilista de capacidad de ejercicio asociada a los actos jurídicos. Se toma como ejemplo para el análisis el ordenamiento jurídico argentino y se formulan conclusiones referidas a la posibilidad de una regulación común.

The civil regulation of legal capacity has been transformed by the conventions on the rights of the child and on the rights of persons with disabilities. In this paper we investigate the projections of these changes in three aspects: the tension between autonomy and protection, the transformations in relation to representatives and support-decision making systems, and the overflow of the civilian notion of exercise capacity associated with legal acts. The Argentine legal system is taken as an example for the analysis and conclusions are made regarding the possibility of a common regulation.
