La doctrina del positivismo en el derecho es predominante en la historia reciente de la teoría jurídica. Tanto en positivo como en negativo, casi todo se ha dicho sobre ella. Sin embargo recientemente se ha abierto un resquicio múltiple en su abordaje sin caer en la repetición, lo irrelevante o incluso pedante, que busca conectar la teoría positivista del derecho con una perspectiva socio jurídica. Este trabajo se incardina en esta última tendencia. Towards a socio-juridical perspective of the positivist theory.
La doctrina del positivismo en el derecho es predominante en la historia reciente de la teoría jurídica. Tanto en positivo como en negativo, casi todo se ha dicho sobre ella. Este trabajo se incardina en esta última tendencia. De tal suerte, se orienta a una revisión de la teoría ius positivista en relación con el vínculo entre dicha teoría y los presupuestos fácticos de la estructura y las dinámicas jurídicas que tal teoría pretende describir conceptualmente, considerando el impacto que las transformaciones sociales de sus presupuestos fácticos han tenido sobre esta teoría.
The doctrine of positivism in law is predominant in the recent history of legal theory. As much in positive as in negative, almost everything has been said about this theory. Nevertheless, recently, without falling in repetition, irrelevance or pedantry, has appeared a thematic opening in its study. This thematic opening looks to connect the theory of positive legal system with a perspective of law and society. This article is located in such tendency. Thus, orients to a revision of the iuspositivive theory in relation to the bond between this theory and dynamic the factual budgets of the structure and the legal ones of which such theory tries a conceptual description, considering the impact that the social transformations of their factual budgets have had on this theory.
